General terms and conditions

Sportalnet Ltd. is a Malta-based company with its registered office in 192, Old Bakery Street, VLT08 Valletta. Its registration number, allocated on February 15th 2005, is C 35668. Sportalnet Ltd was awarded a Class 4 license numbered LGA/CL4/199/2005 for offering Casino Games dated 19/01/2010. Sportalnet Ltd also holds a Class 4 provisional license, numbered LGA/CL4/511/2008 for operating a poker platform dated 23/03/2010. These licenses are issued by the Lotteries and Gaming Authority of Malta and are also regulated by the said authority (www.lga.org.mt).

Vittoriosa Gaming Ltd is a company registered on the 24th January, 2001 under the laws of Malta; Registration number: C27613; registered address: 25, Strait Street, Valletta. Vittoriosa Gaming Ltd is operating its casino games under license numbered LGA/CL1/172/2004 and its poker games under provisional license number LGA/CL3/511/2008 both dated 23/03/2010 awarded by the Lotteries and Gaming Authority of Malta and is also regulated by them (www.lga.org.mt)
The "Terms and Conditions" and “Rules” apply to Vittoriosa Gaming Ltd and Sportalnet Ltd (hereinafter both companies are referred to as ‘Casinò di Vittoriosa’) and their registered Account Holders and constitute and govern the contractual relationship between the Account Holder and the said Companies, as stated herein.
The Account Holder hereby acknowledges and accepts the exclusive validity of such Terms and Conditions and Rules.

In the case of any dispute between the English language version of the terms and conditions and versions in other languages, the English language version shall prevail.
It is recommended that you print a copy of these Terms and Conditions and the Games rules for your records and store them in an easily accessible place.

Account Rules

These Terms and Conditions are subject to alterations which will be displayed to the Account Holder by a visible notice in the web site. All content published in the web site supposes its acceptance by the Account Holder as an integral part of our regulations.

Only persons of legal age, and in any case not less than 18 years old, can log in the portal and operate in it.

Estonian Account Holders should be over 21 years of age.

Residents of Malta, USA or residents in jurisdictions that prohibit on-line gambling cannot register as Account Holders with ‘Casinò di Vittoriosa’.

The Account Holders of  ‘Casinò di Vittoriosa’ agree to abide by these terms and conditions at all times, and also confirm that they are:

• not acting in the interests of any third party;
• not utilizing multiple accounts that are linked to single IP's.
• not utilizing multiple accounts per household.
• not utilizing funds originating from any criminal activity or activities;
• not utilizing bank accounts, debit cards, credit cards they are not authorized to use;
• not going to attempt to hack the website or  to alter its code in any way;
• not going to take part or organize any criminal actions against ‘Casinò di Vittoriosa’, its affiliates and its Account Holders.

Using ‘Casinò di Vittoriosa’ services you can suffer losses of money as a result of your bets placed, and the Account Holder accepts and understands that he is the only person responsible for incurring any losses.

The Account Holder must submit the correct information during his registration. The Account Holder also agrees to update this information should there be any changes to their personal data provided during registration. Changes to their personal details are to be notified immediately to ‘Casinò di Vittoriosa’ support including new validation documents.

A deposit account is necessary to play with ‘Casinò di Vittoriosa’.

If a bet/s is placed or a hand is played using the username and password of an Account Holder it will be considered to have been made by that Account Holder and therefore to be accepted and valid. Account Holders are therefore advised to create strong passwords using different characters and of not less than 6 characters in length (e.g.  oki/098). Account Holders are also advised to keep their passwords secret and to not write it down anywhere.

‘Casinò di Vittoriosa’ reserves the right to accept or deny a request for opening a deposit account. It also reserves the right to request information from authorized agencies in order to verify the data correctness and reliability.

‘Casinò di Vittoriosa’ has the right to examine and confirm the identity of its Account Holders., ‘Casinò di Vittoriosa’ requires that the documentation proving the Account Holder's identity is forwarded to its offices prior to any deposit. Failure to comply with this requirement on the part of the account-holder will oblige ‘Casinò di Vittoriosa’ to lock the account until receipt of the aforementioned documents. Examples of documentation requested could be certified copies of photo ids, bank statements, references, last utility bill,  credit cards (with the last 4 digits only visible) etc…

If an Account Holder’s account remains inactive for a period of 30 months or more, ‘Casinò di Vittoriosa’ is obliged to report such accounts to the Lotteries and Gaming Authority, in accordance with the Remote Gaming Regulations. Casinò di Vittoriosa may be asked to transfer any outstanding balances to the care of the Authority.

Illegal underage Account Holder’s will be immediately suspended and reported to the Lotteries and Gaming Authority, any funds pertaining to such an account shall be forfeited to the Remote Gaming Authority.

‘Casinò di Vittoriosa’ reserves the right to review transaction records and logs, from time to time, for any reason whatsoever. If, upon such review, it appears that end users or any one or combination of them are participating in strategies which ‘Casinò di Vittoriosa’, in their sole discretion deems to be abusive, ‘Casinò di Vittoriosa’ reserves the right to close the Account Holder’s account and withhold funds pending further investigations.

It is the responsibility of the Account Holder to verify that when opening an account and conducting business with ‘Casinò di Vittoriosa’ they are not breaking any laws in their jurisdiction. Furthermore, it is the responsibility of the account holder to determine if winnings derived from gambling activity is taxable in his jurisdiction. We encourage Account Holders to research relevant laws and regulations in their country to determine if they are liable to pay any taxes whatsoever.

You can effect a “Pay in” and/or “Pay out” only from the Portal Account. Account Holders can move funds from the main account of the Portal to the sections of Casino, Poker, Sports-book or Exchange using the Inter-account function.

The acceptance of an inter-account transfer or pay out request is dependent on the availability of funds in your account. If the transactions are erroneously processed, even though the Account Holder has not got enough funds, the transaction will be canceled or paid in proportion to the real available amount.

Account Holders’ funds are placed in a ’Client Account’ held at a reputable bank where the balance is constantly controlled by the Gaming Authority in Malta.

Only the Account Holder knows his Password and, as a consequence, he is the only one who takes the full responsibility for its incorrect or fraudulent use. If the Account Holder looses his Password he can contact the Account Holder Service who will provide him with a temporary one by e-mail or over the phone. Once the Account Holder logs in with the new password into the portal he should immediately change it to a personalized one.

If transactions are processed by third parties who know the Password they will be considered valid.

‘Casinò di Vittoriosa’ reserves the right to close an Account Holder’s account at any moment without giving any explanation.
In the event of an Account Holder not respecting one or more of the rules as mentioned, ‘Casinò di Vittoriosa’ will close the account and confiscate any available funds. Furthermore ‘Casinò di Vittoriosa’ reserves the right to charge any processing fees to the Account Holder.

Deposits, Transfers and Withdrawals

Account Holders can credit their account choosing one of the following payment methods:

- Credit Card (VISA and MASTERCARD);
- Prepaid Card (VISA Electron);
- Internet Banking e.g.  Neteller,  Moneybookers;
- Bank Transfer;
- Any other payment method authorized by the Maltese Authority Gaming.

The Account-Holder can withdraw money from his Account choosing one of the following methods:

- Bank Transfer;
- Neteller, Moneybookers;
- Credit Card

The name on the credit card or the bank transfer should be identical to that of the Account-Holder receiving the funds. If this is not the case the deposit will be rejected  and any charges levied by the banks/payment gateways will be deducted from the reversed amount.

When depositing by credit card your credit card account will be debited immediately upon completion of the transaction.

It is also suggested that you print all transaction data and keep it readily accessible for your own records.

Any funds deposited must be utilized for the placing of bets.  All transactions are monitored for money-laundering activities and any suspicious activity on an account could lead to the Account Holder being reported to the relevant authorities and freezing of the funds and could also lead to the closure of the account and confiscation of the funds.

The Refund Policy of 'Casinò di Vittoriosa' is to not to effect any refunds. However, it remains at the management’s discretion to determine whether a refund request for a deposit made should be entertained.

Refunds will only be done through the same deposit method once the origination of funds and account have been  verified. A refund can take place seven days after the deposit was made.

Promotions/Bonus can from time to time be placed into the Account Holder’s account as part of a sales promotion/marketing campaign. These promotions/bonus cannot be withdrawn/paid-out but must be used for the placing of bets. A promotion/bonus must be used within two months of it being placed in to the account or else it will be withdrawn. Promotions/Bonus campaigns will have different rules that can be found in the Promotions/Bonus section which are to be followed by Account Holders.

Funds cannot be transferred from the account of one Account Holder to the account of another Account Holder.

An Account Holder can at any time log-in to his account and view a statement of his account which would show all transactions effected on that account, namely deposits, bonuses, winnings, bets and withdrawals. Should the Account Holder notice any mistakes he should notify Customer Care Service immediately so that the mistake can be rectified. The Account Holders should report such a mistake within 90 days from when the mistake first appeared on the statement available on the website.

At any time, the Account Holder can decide to withdraw part or all of his funds from his account by selecting from the various options made available by Casinò di Vittoriosa. Depending on the currency and on the chosen withdrawal option, certain transaction fees may apply. All bank or payment processor fees will be borne by the Account Holder. Once all the available funds have been withdrawn, the Account Holder has the right to close his Casinò di Vittoriosa account if he/she wishes to do so.

Account Holders must not treat Casinò di Vittoriosa as a financial institution. No interest is paid on any funds, irrespective of the amount, held in the Account Holder’s account.

'Casinò di Vittoriosa' will do its utmost to process any withdrawal requests within 3-5 working days from the receipt of such request.

Bank transfers might take longer to be processed by  banks in some locations.

The Account Holder acknowledges that 'Casinò di Vittoriosa' may only entertain withdrawal requests once it is satisfied on the Account Holder’s identity and the completeness and accuracy of all information provided.

In order to guarantee the highest security standards to our Account Holders all our financial transactions on the portal 'Casinò di Vittoriosa' are processed over a secure connection using Secure Socket Layer(SSL).

Fees and “Pay-in” and “Pay-out” charges will be charged to the Account Holder according to the Payments Section.

Payments by Credit or Debit Cards will be accepted only if the Credit Card Holder is the same as the Account Holder.

In order to "Enable" your Credit Card our Customer Service has to register and validate it.

In order to enable your Credit Card, once it has been used for the first time on our Portal, simply send a copy of your Identity Card or passport and a front and back copy of your Credit Card to our Customer Service. All the financial transactions processed with 'Casinò di Vittoriosa' are processed by Sportalnet Ltd. of 192, Old Bakery Street, VLT08 Valletta, Malta, and the charge will appear on your statement as CASINOVENEZIA.COM

In the case of Credit Card deposits 'Casinò di Vittoriosa' reserves the right to cancel the bets and refund the stakes if the Account-Holder engages in betting activities before providing the requested documentation.

Any mistakes concerning the bank credits must be notified to 'Casinò di Vittoriosa' so that the required adjustments may be made immediately.

All winnings resulting from an invalid deposit will be annulled.

Venice Pass

For the added security and integrity of our poker network and player database, 'Casinò di Vittoriosa' requires Account Holders to use the Venice Pass security feature in order to make use of certain deposit methods available. For further information in relation to the Venice Pass please refer to the appropriate section of the website.

General Betting Rules

Sports Betting General Rules

A bet can only be placed via the Internet by a registered Account Holder, under the provision that there are sufficient funds in the 'Casinò di Vittoriosa' account '.

Bets, once submitted, will be governed by the version of the Terms and Conditions valid at the time of the bet being accepted.

A bet is deemed to have been placed as soon as confirmation of the acceptance of the betting offer is received from 'Casinò di Vittoriosa'.

The Account Holder affirms that at the time he placed a bet, or bets, he had no knowledge as to the outcome of the respective event/s. Bets on events in which the Account Holder is directly involved, or has access to insider information about, are forbidden. Where there is suspicion of a violation of this rule, 'Casinò di Vittoriosa' retains the right to void the bet and refuse to pay out the eventual winnings. It also retains the right to take any further action it deems necessary to protect its legitimate interests and to comply with existing laws and regulations.

'Casinò di Vittoriosa' retains the right to decline or to accept bets without providing any reasons.

The minimum stake is 1 Euro
The maximum stake is 10000 Euro

In the case of combination bets, the minimum stake per row in the bet-slip is 1 Euro.  The complete list of all bets, their status and further details are available to the Account Holder on the website when he logs in to his account.

'Casinò di Vittoriosa' retains the right to limit the amounts staked by its Account Holders on certain markets and from certain locations.

'Casinò di Vittoriosa' retains the right to declare all bets on an event or events invalid if they emanate from a group of Account Holders who appear to have had knowledge of the outcome of such event/s and acted together to take advantage of such knowledge - e.g. syndicated betting.

When a bet is declared invalid or void, the odds will be set to 1.00. The Account Holders will be reimbursed of the amount staked. In the case of combination bets, the invalid result will not be included in the calculation of the (total) odds.

Apart from live betting, any bet concluded after the start of the event becomes invalid and the odds will be set to 1.00.

Should 'Casinò di Vittoriosa' decide to close an Account Holder's account, bets which have already been placed and accepted will not be voided and the Account Holder will be paid any resulting winnings. This applies only to accounts on which a bonus has never been claimed. For accounts which have received a bonus, please refer to Account Rules and to the Bonus Terms and Conditions. A bet which has been placed and accepted cannot be amended, withdrawn or canceled. A mistake regarding the details of a bet or bets will not influence the validity of the bet. If the event on which the bet has been placed is incorrect then this will automatically void the bet.

'Casinò di Vittoriosa' endeavors to make no mistakes during the odds publication; if any mistake is inadvertently made 'Casinò di Vittoriosa' reserve the right to modify the odds accordingly, even after the event has finished. An 'error' is a material mistake about odd inserting or exchanging;  arbitration  will be based on other web companies’ opinions and odds.

'Casinò di Vittoriosa' reserves the right to cancel and void repeat bets which contain the same selection. That means Account Holders who place identical bets more than once risk having these bets revoked.

'Casinò di Vittoriosa' reserves the right to refuse the whole or part of any bet and to make ambiguous bets void.

When the Account Holder places a bet/s he acknowledges that he has read and understood in full all of the terms and conditions and game rules regarding the bets offered by 'Casinò di Vittoriosa' as stated on the website.

'Casinò di Vittoriosa' manages the Account Holder's account, calculates the available funds, the pending funds, the betting funds as well as the amount of the winnings. Unless proven otherwise, these amounts are considered as final and are not subject to any dispute.

The Account Holder is fully responsible for the betting orders placed over the Internet. 'Casinò di Vittoriosa' will never question the Account Holder about the relevance of the bets they wish to place and will not be held responsible for the possible mistakes that could have been made during the placing of such bets, including mistakes regarding the amounts staked.

'Results' are the ones achieved on the ground, track, field or podium. Possible theoretical results, gained by disciplinary, sport justice or ordinary actions, will not be taken into consideration. In case of 'illicit sport', 'Casinò di Vittoriosa' reserves the right to freeze the winnings or to not pay them.
All the dates and hours of the matches published on the web site are approximate; in order to correct any bets these dates and hours are taken from the competent organizations and authorities.

Winnings on bets with Fixed Odds are calculated by the multiplication of the amount placed by the per-determined odds.

Bets erroneously accepted after the event has started will be considered void; if the event belongs to a multi-account holder then the selection will be considered void.

Winnings will be paid into the Account Holder's account after the final result is confirmed. Any later amendment to the result, e.g. disciplinary procedures (doping) or intervention by ruling bodies have no influence on the result. However, 'Casinò di Vittoriosa' reserves the right to set aside any winnings should there be investigations into an event as a result of a suspicion of criminal activities that may have affected the result of the event. If the irregularity is confirmed then 'Casinò di Vittoriosa' retains the right to void any related bets.

A bet is declared void if an event is canceled or abandoned and no final result is declared within 24 hours. The following limits apply on winnings per Account Holder:

• The maximum winning is 25,000 Euro
• The maximum winning allowed for a combo bet is 1000 times the amount wagered with a maximum payment of 50,000

'Casinò di Vittoriosa' retains the right to reduce the amount wagered by an Account Holder if the above limits will be surpassed should the Account Holder prove successful with his bet. The difference between the original amount wagered by the Account Holders and the amount revised by 'Casinò di Vittoriosa' will be paid back into his account.

Should 'Casinò di Vittoriosa' become aware that an Account Holder has placed a number of bets from different accounts he has irregularly opened, then the above limits will be applied across all accounts. 'Casinò di Vittoriosa' retains the right to take further action as deemed necessary.

Account Holders may apply for higher limits and written agreements can be reached to increase these limits. If bets, which exceed the stated limits, are erroneously accepted, the excess amount will be disregarded and the bet amount placed will be revised accordingly and the difference paid back to the Account Holders.

'Casinò di Vittoriosa' retains the right to reduce the limits on any event at any time.

Account Holders may also set their own limits on the amounts they permit themselves to bet on a daily, weekly or monthly basis. The limits can be set directly from the 'my account' section. The Account Holder can request the removal of his/her limits by sending an email to This email address is being protected from spambots. You need JavaScript enabled to view it.   This e-mail address is protected from Spam-bots. You will need JavaScript enabled to view it . The limits will be removed (or reduced) 7 days after the Account Holder submits the request. Requests to further restrict these limits will take place immediately.

Account Holders may also lock their accounts if they no longer wish to place bets.

Should they subsequently change their minds, Account Holders may contact 'Casinò di Vittoriosa' to unlock their account – similarly,  this will not take place before a period of seven days from the locking of the account has elapsed.

Further rules may be found in the section Rules > Casino which form part of the general Terms &Conditions and are to be followed at all times by Account Holders.

Casino and Poker Rules

Bets are only valid if they have an ID (Identification Code). In case of any dispute, the files and records of 'Casinò di Vittoriosa' will be considered the only acceptable and valid proof.

It will not be the responsibility of  'Casinò di Vittoriosa' if the Internet, browser or computer of the Account-Holder do not work correctly.

'Casinò di Vittoriosa' advises Account Holders to use the portal only whilst using fast and reliable Internet connections (Adsl or Optical Fiber).

In the Multi-Player and Live versions, bets are only valid once "Bet Confirmed" or a similar message is received by the server.

In the case of Virtual Games you acknowledge that our random number generator will determine the outcome of the games played on the Poker Room and Casino tables and you accept the outcomes of all such games. You further agree that in the unlikely event of a disagreement between the result that appears on the Software and the game server, the result that appears on the game server will prevail and you acknowledge and agree that our records will be the final authority in determining the terms and circumstances of your participation in the Poker Room or Casino games and related gaming activity.

Once you place a bet you have to validate it by clicking on the “Send” button. After this operation you will be not able to modify or cancel it anymore.

The minimum and maximum amounts allowed for bets are the ones indicated on the chosen table.

In the Live version the results of the games are read by optical readers; if they should happen to malfunction, the game in progress will be voided and this decision may not be challenged.

In the case of Live Roulette, should there be a mis-spin, then all bets will be confirmed and the spin will be repeated.

If a system error occurs while placing a bet, the bet will be considered valid or invalid according to the error which has occurred. If it is an error originating on the Account Holders side,  we will probably receive the bet confirmation and if such is the case, then your bet will be considered valid. Players can check their own bet history in the 'Bet List' section when they successively log-in to the portal . If the connection is terminated by 'Casinò di Vittoriosa' system malfunction and/or hardware failures, thus without validating bet requests, then the bet will be considered void.

Should there be any lack of conformity between the Live Results, the results displayed in the live streaming window , and the results displayed by the software, then the  true result will be determined as the one displayed by the Live Streaming.

The minimum and maximum stakes vary according to each game. For more info please refer to the rules section provided for each game.

Live games are streamed within the Central European time zone.

Further rules may be found in the section Rules > Casino which are an extension to, and form part of the general Terms & Conditions which are to be followed at all times by Account Holders.

Software Download Conditions

The Software is owned by, and is the exclusive property of,  'Casinò di Vittoriosa'. The Software and accompanying documentation which have been licensed to us are proprietary products of 'Casinò di Vittoriosa' and are protected throughout the world by copyright law. Your use of the Software does not give you ownership of any intellectual property rights in the Software. This Agreement applies only to the grant of the license to use the Software.

The Software is provided “as is” without any warranties, conditions, undertakings or representations, express or implied, statutory or otherwise. We hereby exclude all implied terms, conditions and warranties (including any of merchantability, satisfactory quality and fitness for any particular purpose). We do not warrant that the Software will meet your requirements.

We do not warrant that the Software will be non-infringing or that the operation of the Software will be error-free or uninterrupted or that any defects in the Software will be corrected, or that the Software or the servers are virus-free. In the event of communications or system errors occurring in connection with the settlement of accounts or other features or components of the Software, neither 'Casinò di Vittoriosa' nor our Software provider will be liable to you or to any third party for any costs, expenses, losses or claims arising resulting from such errors. We further reserve the right in the event of such errors to remove all relevant games from the Software and the website and take any other action to correct such errors.

You hereby acknowledge that the responsibility with regards to software usage is yours and yours alone. You load and use the Software at your own risk and in no event shall we be liable to you for any direct, consequential, incidental or special damage or loss of any kind.

The Software may include confidential information which is secret and valuable to us. you are not entitled to use or disclose that confidential information other than strictly in accordance with the terms of this Agreement.

Other Terms

Cancellations

Without restricting our ability to rely on other remedies that may be available to us, we will suspend or terminate your account or cancel any unmatched bets at our absolute discretion if:

(i) we suspect that you are engaging in illegal or fraudulent activity while using our Exchange;
(ii)  we suspect you are breaching any term of this agreement;
(iii) we suspect you are acting in a manner that is detrimental to the conduct of our business.

Irrespective of whether we suspend or terminate an account and notwithstanding any other provisions in these terms and conditions, we may decide to cancel and void any outstanding or matched bets at our absolute discretion where (i) there is a technological failure, or (ii) you or another Account Holder with whom you have bet have breached any terms and conditions in this agreement.

You may not accept any offer for a bet or acceptance of a bet that results in your reserved balance exceeding the lesser of your Available balances.

In the event that we inadvertently process an offer for a bet or the acceptance of a bet in an amount outside the applicable thresholds, such bet will nevertheless stand and be subject to the other terms of this agreement.

Nature of bets

You acknowledge that all bets placed on the Exchange  are actually a combination of one or more fixed odds bets. The exact combination of odds is shown in the betting slip.

You accept that you consider yourself to be adequately informed of your possible exposure by the details given on the betting slip.

You accept that any amounts lost by you under any bet should not under any circumstances be recoverable from 'Casinò di Vittoriosa.'

We suggest that Account Holders not  use the ‘Remember Password’ feature of their browsers, and that Account Holders keep their computer’s anti-virus, anti-spyware and firewall software updated regularly to prevent damage to their systems and/or their data being stolen.

Liability

'Casinò di Vittoriosa' is only liable for gross negligence or deliberate actions carried out by its management, employees or vicarious agents.

'Casinò di Vittoriosa' is not responsible for the services, pages or contents of websites to which links may be provided from time to time from the 'Casinò di Vittoriosa' website.

'Casinò di Vittoriosa' is not responsible for any consequences resulting from major incidents such as any strike, terrorist activities, political crisis, war, and saturation of the telecommunication networks, natural catastrophe; which could lead to a total or partial reduction of access to its services, on Internet or by phone.

Casinò di Vittoriosa is not to be held responsible for the consequences caused by the breakdown of any device or software, directly managed or outsourced, which could lead to a total or partial reduction in access to its Services, via Internet or by phone.

In the event of any mistake or negligent act on the part of 'Casinò di Vittoriosa', in relation to these Terms and Conditions, the compensation available to the Account Holder would never be any higher than the available funds on the Account Holder’s account or the amount of the bets involved in the mistake or negligent act.

Should one or more term or condition of this agreement be declared void by a recognized Court of Justice, then the remaining Terms & Conditions would retain their validity.

These Terms & Conditions represent the whole of the agreement between 'Casinò di Vittoriosa' and the Account Holder, and replace any previous written or verbal agreement, communicated by 'Casinò di Vittoriosa.'

'Casinò di Vittoriosa' does not accept any liability whatsoever for damage to a Account Holder or a third party which arises directly or indirectly from a mistake, misprint, malfunction of software on the 'Casinò di Vittoriosa' website or that of any of its affiliates and/or partners.

Rules

However, there may be occasions where a Account Holder may feel dissatisfied with the quality of our product/s or of our Account Holder service. Affiliates terms and conditions

The following Terms and Conditions are valid since October 1st, 2011. This contract (referred to as the “Contract”), sets the Terms and Conditions between You (the “Affiliate”) and casinodivittoriosa.com (the “Company”).

1. General Information
   1. By filling out the Registration Form, and subsequently by marketing and indicating new Members to Casinò di Vittoriosa Malta , you consent to being bound by all the Terms and Conditions set out in this Contrat.
   2. To complete the registration, a Player Account on casinodivittoriosa.com is required.
   3. You are bound to always provide us with reliable and complete information; including but not limited to the contacts, the instructions for the payments, the nationality, the address, the location and the nature of your marketing activities, as well as any other information casinodivittoriosa.com may request of You.
   4. By accepting this Contract, provided the completion of the Registration Form, casinodivittoriosa.com will become Your counter-party in the present Contract.
2. Marketing
   1. You can market and communicate, at your own expenses, to potential casinodivittoriosa.com clients. You will be solely and uniquely responsible for the content and the mode of operation of Your marketing activities. You are forbidden to address Your marketing activities to individuals under the legal age, or in jurisdictions where such activities might be deemed to be illegal.
   2. casinodivittoriosa.com will create promotional material such as banners, text links, registration promotional codes, and other links and tools that might be helpful to You to find new Members linkable to your name.
   3. You are allowed to promote only through the approved marketing activities. It is strictly forbidden to use spam E-mail or advertising on adult websites, as well as trying to recruit Members through the chat in casinodivittoriosa.com. In case casinodivittoriosa.com gets knowledge of your partaking in any such activity, it will reserve the right to immediately close Your account, keeping all your earnings.
   4. In case You desire to offer any incentives to potential new members, beside the bonuses linked to Your sign-up codes, before proceeding You must receive the Company’s approval. In case You offered said incentives without having received any approval from the Company, casinodivittoriosa.com reserves the right to cancel Your participation in the Affiliate Program, keeping all your earnings.
3. Poker Commissions
   1. The Affiliate will receive commissions complying to the Percentage Prospect on the poker weekly net revenue as of paragraph 3.2.
   2. The term “Poker weekly Net Revenue” means the gross revenue deduced of the costs for Players promotions (bonuses, tournament sponsorships, Vip points, taxes, etc) and any chargeback costs (Credit card frauds). The gross revenue is comprised of the revenue derived from cash games and tournaments.
   3. In case the Poker Weekly Gross Revenue is negative, the negative balance will be accounted for the subsequent month.
4. Casino Commissions
   1. The Affiliate will receive a monthly bonus the first Monday after the 4th week on the net revenue in compensation between winnings and losing of his clients in Casino games available on the website www.casinodivittoriosa.com
   2. The calculations for the payment of commissions will take place between 00:01 of the night between Sunday and Monday, to end at 23:59 of the fourth subsequent Sunday or anyway at the beginning of the calendar month referred to.
   3. The commissions are calculated as in the following example:
      • Player’s comprehensive losses– Player’s bonuses = net revenue.
      • The percentage for the Affiliate will be calculated on the net revenue according to the percantage agreed.
      • In case the winnings of a Player exceed the losses of said Player at the end of the 4 weeks period, the Affiliate will not receive any commission.
5. Commissions Percentages
   1. The Affiliate will receive commissions or monthly bonuses according to his agreement with the affiliate manager.
6. Tracking
   1. Every new Member using a specific Affiliate tracking URL or sign-up code will be automatically connected to the Affiliate. The codes can be assigned in a limited or unlimited number an can be matched to different promotions.
   2. The term “New Member” refers to a new user, that has never opened a gaming account on casinodivittoriosa.com before, has never registered his/her e-mail address before nor any other personal detail which might lead to a connection with an existing account on casinodivittoriosa ; that opens a new gaming account. Neither You nor any of Your Relatives can become a “New Member” through Your Affiliate account; in case this happened the related Royalties will not be credited to You. The estimate and calculation related to the number of New Members and the figures of the Poker Gross Revenue are made by casinodivittoriosa , and will have a unique and definitive value, and may not be object of reviews or claims.
   3. To calculate your royalties, casinodivittoriosa.com will keep track of and take note of all activities of your Members. You will be provided with a secure Web interface which will enable you to follow your Member’s activities. Usually, all data will be updated at least on a daily basis.
7. Balance
   1. To deposit money in a casinodivittoriosa.com account, it’s necessary to own an account with Moneybookers, or any other available gateway, or a Credit Card. All Royalties will be paid on a monthly basis in the Affiliate Account. Before determining the royalties, casinodivittoriosa.com reserves the right to freeze the payouts in case it was necessary to engage in investigations regarding frauds or abuses. It is possible to make withdrawals from the Player Account using different payment methods.
   2. In case the promotions and chargeback exceed the gross revenue, the net losses will be visible in the monthly report.
   3. In case the Affiliate does not agree with a report on his/her balance or on the amount due, the payment of said amount will not be accepted and it will be necessary for the Affiliate to immediately send a written notice to casinodivittoriosa.comin relation to the amount contested. Such notifications on discrepancies will have to be received within ten (10) days from the expiration of any period covered by the payment; the written notice will have to be sent via e-mail to the address: supportcasinodivittoriosa.info; otherwise the Affiliate will lose all right to dispute said report or payment.
   4. The Affiliate takes full responsibility to take note of his revenues and to pay the taxes (where applicable) to local authorities. casinodivittoriosa, as a licensee, is subject to the taxes in the state of Malta.
8. Duration and Termination
   1. This Contract will come into effect as the Affiliate fill in the Registration Form and accepts the Terms of Service.
   2. This Contract has an unlimited duration and will stay into effect as long as both parties carry out their obligations and until one of Them terminates the Contract.
   3. Both Parties may terminate this Contract at any time, with or without motivation, by informing the other Party. Such notice will be in writing and may be send by e-mail or fax.
   4. In case You interrupt the promotion of casinodivittoriosa ’s services, casinodivittoriosa.comwill have the right to terminate this Contract, without having to give notice of it.
   5. In case this Contract is terminated, You will be required to immediately remove all links, trademarks, logos, etc from Your website.
   6. In case this Contract is terminated by casinodivittoriosa , without any of the motivations shown in paragraph 8.7, 8.8, 8.9, casinodivittoriosa.com will keep on paying the royalties due to the revenues generated by existing Members registered prior to the date of termination.
   7. In Case the Affiliate terminates this Contract, casinodivittoriosa.comwill pay all due royalties as of the date of termination, but will be freed of the obligation to pay any further royalty to Your Account.
   8. In case the Members of the Affiliate failed to generate a total gross revenue equal to at least €100 for three (3) consecutive months, casinodivittoriosa.com will have the right to terminate this Contract, without the obligation to pay any further royalty to the Affiliate’s Account. The above is applicable in case the Contract was already terminated, but the royalties still due, in compliance with what is set in paragraph 6.6.
   9. If not differently specified in this Contract, in case casinodivittoriosa.com is convinced, to its reasonable discretion, that the Affiliate has materially breached this Contract, then casinodivittoriosa.com will have the right, to its sole discretion, to terminate this Contract.
9. Rights and Obligations
   1. If not differently agreed between the Parties, the Member tied to the Affiliate will remain tied to him/her until this Contract is in effect. In case of a change of ownership of casinodivittoriosa , the new owners will be bound by the obligations of this Contract.
   2. casinodivittoriosa reserves the right to transfer its rights and obligations under this Contract to another Party, prior a notification to the Affiliate. Such notification will be considered given after the update in the Terms and Conditions for Affiliates on the casinodivittoriosa.com website, or after a written notification is sent to the Affiliate.
   3. The Affiliate does not have the right to assign or transfer this Contract, and the rights and obligations set out in it, without prior written authorization from casinodivittoriosa.
10. Responsibilities
    1. The Company does not warrant that its system, its network, its software or hardware is free of errors or malfunctions.
    2. The obligations of casinodivittoriosa.com in relation to this Contract do not constitute personal obligations of any administrator, functionary, employee, shareholder of casinodivittoriosa.com or any other company or partner. Any liability due to the obligations in this Contract will be satisfied only using the revenues generated. The responsibility of casinodivittoriosa.com is limited to direct damage, and casinodivittoriosa.com will in no case be held responsible or liable of indirect losses, special, accidental, consequent or punitive, accidents or any kind of damage.
    3. You confirm to have read and understood this Contract, and accept to agree to all the terms and conditions set out in it.
    4. The system allows the transfer of funds between affiliate accounts. Such transfers happen through the backoffice and are a complete responsibility of the Affiliates themselves, being that they have exclusive control of their Account. casinodivittoriosa.com is in no way responsible for mistakes or fraudulent activities related to transfers of funds between affiliates accounts.
11. Miscellaneous
    1. casinodivittoriosa.com reserves the right to modify, at any time, any term of this Contract, to its sole discretion, sending You a notification e-mail reporting the changes, or mailing You the new version of the Contract with casinodivittoriosa . It is Your responsibility to consult the website frequently, and to verify to be in possession of the updated version of the Contract and the related dispositions. In case You find a change to be unacceptable, Your only resource if that of terminating this Contract. Your participation in the Program after the receipt of the notification will be considered an acceptance of the changes.
    2. All notifications regarding this Contract will be sent to casinodivittoriosa.com in writing or by e-mail, otherwise they will be considered void. The notifications to the Affiliate will be sent to the e-mail address provided in the Affiliate Account.
    3. The validity of this Contract, its interpretation and application, as well as the rights and obligations of the Parties, are determined under the Laws of Malta.
    4. The deposits of the Members merge into a clients account subjected to constant control and monitoring by the Lotteries and Gaming Authority in Malta.

House rules (Poker)

Disputes

Should any dispute arise, the decision of the Casinò Vittoriosa Poker Management Team will be final.

The Management reserves the right to close any table at any time at their sole discretion and without having to give prior notice.

The Management also reserves the right to disable or suspend a player or a group of players for a time period to be determined by management for any violation of house rules.

Even though it is extremely unlikely, a server crash may occur with any Internet application. In such an event, customers will have their accounts automatically refunded with the amount of chips they had at the table, both in play and out of play.

In the unlikely event that a pot was awarded wrongly, the Management has the right to adjust players’ account balances to correct any and all inconsistencies and will contact the players involved and provide them with a hand history and a detailed explanation within 48 hours.

Voided Hands (Live Poker)

The Management will void a hand in-play and return all stakes to participants in the following cases:

1. an error occurs with the fiber-optic reader or any other unspecified technical error;
2. two cards are drawn by mistake or any other unspecified type of misdeal.

With regards to human error, the only case in which the hand will not be voided is the following: the croupier mistakenly mixes previously folded cards with the remaining deck cards before the River. Should this situation arise, the croupier will proceed as follows:

1. remix the deck cards and place them anew in the shoe (sabot);
2. re-draw the cards from the shoe until the River or until the game is over;
3. should the extracted card be one of the previously folded cards, the system will notify the card is to be discarded and the following card will be extracted from the shoe.

Should it not be possible to correct an issue in real-time, because the system has already acquired misread card data for example, then the hand will be declared void: within 48 hours, and after examining both the game data and the live feed, the Management reserves the right to amend players' balances accordingly.

Disconnection Policy

If the player loses connection and does not play within the specified period the hand will be automatically folded.

If the disconnection occurs from the server side and all players are disconnected the game will be voided and all bets placed in the interrupted game will be refunded to the players.

Collusion

If team play (also known as collusion) is suspected, the Management has the right to suspend the suspicious accounts and freeze their funds while an investigation is conducted.

Players found to have been acting, or reasonably suspected of acting as a team, will have their account privileges on the portal indefinitely terminated as well as throughout all the casinos operated by Casinò Vittoriosa.

Casinò Vittoriosa membership can be revoked at anytime for any reason.

The funds in a player’s account will be returned unless the player has been found to have cheated another player or players, in which case some or all of the funds may be distributed to the victims of the abuse.

Should funds be returned to a player having broken the house rules, a 25€ administrative fee may be applied. In no event will Casinò Vittoriosa confiscate funds for its own use. Funds arising or left over from fraudulent activities will be transferred to the gaming authority.

Rake

A rake equal to 5% is applied uniformly to all tables and is capped at a maximum of 5€ per hand on virtual, 2€ on heads-up and 10€ on 'live' tables.
